Health Law

This guide supports the research, instructional, and outreach activities of the Hamline University Health Law Institute. The scope of health law is wide and open to interpretation.Broadly defined, health law is the international, federal, state and local law governing healthcare-related organizations or relating to human health.  Facets of health law can implicate torts (especially medical malpractice), contracts, antitrust, insurance, and privacy. The term “health law” sometimes is used interchangeably with “medical law,” but more often “medical law” is a narrower term encompassing only healthcare provider-patient relationships. Legislative, administrative, and judicial control over medical practice and medical matters has been growing for many decades. Topics overlapping or closely related to health law include bioethics and elder law. This guide emphasizes federal law regulating healthcare-related entities, finance/reimbursement, or medical devices.
